On fresh material and changed circumstances the Court allowed the appeal in part by ordering that the applicant's detention be at Castle Peak Mental Hospital rather than Siu Lam Psychiatric Centre because medical opinion established that hospital treatment and availability thereof gave the applicant the best prospect of safe release; the absence of medical confidence as to duration justified leaving the hospital order without a specified term; the court declined to disapply the proviso to s.47(2) on expert advice.
