The appeal was dismissed and permission refused because the proposed claim merely re-litigated matters already finally determined by prior proceedings and orders (including the HCMP 2594/2002 sale order vesting the property in the respondent), constituted an abuse of process, raised no arguable new grounds and was therefore barred by the existing restricted proceedings order; accordingly leave to proceed was properly denied and further restrictions on future appeals under Practice Direction 11.3 were justified.
