The SFAT is entitled and obliged under the SFO to exercise its independent judgment and conduct a full merits review capable of substituting its own decision; there was no legal error in SFAT reducing the SFC's lifetime prohibition to a 10 year prohibition and the Court of Appeal dismissed the SFC's appeal and upheld SFAT's decision.
