The Court of Appeal held that the contempts for scandalising the court were criminal contempts constituting convictions of criminal offences for the purposes of Article 13(4)(d) of the HKIE Constitution; therefore the Board of Inquiry's finding of improper conduct and the council's suspension order were founded on established convictions and the plaintiff's claim challenging the suspension disclosed no reasonable cause of action, was frivolous or vexatious and an abuse of process and was rightly struck out.
