Summary judgment was refused and the defendant was granted unconditional leave to defend because there existed a real legal issue as to whether the implied term relied upon by the bank could be incorporated into the banking contract and triable factual issues (notably the circumstances of the US$313,312.90 credit) that required a full trial; accordingly the plaintiff's claim for immediate release on summary judgment failed.
