The Court held that the Judge properly exercised his discretion in refusing to set aside or postpone the Order 49B examinations: non-disclosure of the pending actions in the ex parte affidavit was not material to the order, there was no evidence of an ulterior motive or that the Bank would obtain an unfair collateral advantage, and the examination could be limited by the examiner and the court to prevent probing trial evidence; accordingly the appeals were dismissed.
