The Coroner directed that the next of kin of seven of the deceased will participate, confirmed disclosure of death investigation reports to properly interested participating persons, fixed the inquest listing for 6 May 2025 with 60 days reserved, and scheduled a third pre-inquest review on 14 January 2025 to address requests for further information and outstanding matters.

The Court dismissed the appeal and refused leave: the Railways Ordinance does not require CEIC to give reasons, the decision was not aberrant nor did it engage fundamental rights such that fairness required reasons or disclosure, the statutory compensation scheme and the open procedural steps taken (panel hearing, expert exchange) sufficed to protect objectors, and BL35 did not create an independent duty to give reasons; accordingly there was no reasonably arguable case for the proposed peripheral challenges and no duty to disclose documents relied upon.

The Board's decision was quashed because it applied or at least gave an impression of applying an impermissible 'special reason' threshold inconsistent with LTPSRO s.8, breached procedural fairness by failing to disclose materials that it had considered and by failing to give adequate reasons for a decision affecting liberty, and thereby failed to take into account relevant statutory factors; the decision must be remitted for reconsideration.
