The Court refused leave to appeal because the originating claim did not fall within either limb of s.22(1)(a) of the CFA Ordinance, the issues did not raise questions of great general or public importance, and the applicant had standing to assert the charitable trust to protect trust interests; accordingly leave was refused and costs awarded to the applicant subject to the conditional provision concerning any subsequent leave to the Court of Final Appeal.
