The application for a split trial and for liability to be determined as a preliminary issue was refused because, although certain liability issues (parentage and dependency status) are conceptually distinct from quantum, evidence about the size and nature of the estate and financial means is probative of both liability and quantum and the parties had framed and intended to present evidence that intertwined those matters; a separate trial would therefore be unjust to the Pangs and inconvenient, giving the Administrator an unfair advantage.
