The court held that the 1st Defendant is estopped from denying that the deceased was employed by it because that matter was finally determined/admitted in prior Workmen's Compensation proceedings, and therefore the 1st Defendant is not entitled to further particulars on employment; however, the plaintiff must provide further and better particulars limited to paragraph 8(v) concerning safety supervision because without them the 1st Defendant cannot know the nature of the evidence to meet that allegation.
