The Court held that while Hong Kong courts can issue worldwide Mareva injunctions following the same principles as domestic freezing orders (good arguable case, reason to think assets abroad and insufficient assets locally, and real risk of dissipation), on the facts before the court the plaintiffs failed to demonstrate a real risk of deliberate dissipation or concealment of assets prior to judgment; accordingly the Mareva injunctions should be discharged and the appeal dismissed.
