The appeal was dismissed because s67A does not entitle deduction for judicial detention unrelated by nexus or proximity to the offence; while a narrow residual discretion exists to award credit for unrelated custody in exceptional cases, no special circumstances were shown here (no nexus/proximity, no unique injustice), and therefore the 212 days of prior judicial detention could not be deducted from the 15 month sentence.
