Application to vary the costs order nisi to indemnity costs was dismissed. Although the plaintiff's evidence was found dubious and aspects of the claim were unreliable and possibly dishonest, the judge refused indemnity costs because the defendant's mismanagement and conduct contributed to the situation and indemnity would be a disproportionate punishment; the $2,000,000 paid into court was ordered paid out to the defendant and the defendant was ordered to pay the plaintiff's costs of the summons.
