The Court upheld the conviction for dishonestly avoiding payment (Charge 1): the appellant left without payment and, applying the Ghosh test, his conduct was dishonest both objectively and subjectively. The Court allowed the appeal against conviction for assault occasioning actual bodily harm (Charge 2) because the evidence was insufficient to establish how Mr Wong sustained injuries or to link them to the appellant beyond reasonable doubt, so conviction and sentence for Charge 2 were quashed.
