The claimant's unexplained failure to comply with court directions (failure to file trial bundle and opening statement) and his absence on the trial date justified dismissal of the employees' compensation claim; dismissal was proportionate and not unfair and the respondent was entitled to costs.

The summons for leave to appeal was dismissed because the applicant failed to demonstrate a reasonable prospect of success and failed to prove non-receipt of the court's notice; there were no other reasons in the interests of justice to justify a hearing. Consequently the summons was revoked and costs awarded to the respondent.

The magistrate lawfully refused to issue the five private summonses because the material before him was insufficient in particulars and substance to establish the essential ingredients of the alleged offences, and allegations of contempt outside the face of the court were not actionable in the Magistrates' Courts; there was no evidence of bias and no unfair hearing, therefore the appeals are dismissed.

The court refused to restore the applicant's claim because the applicant failed to establish a reasonable explanation for non‑attendance (evidence showed she had access to the former address and had not promptly informed the court or the parties of her move), her conduct was at least negligent if not deliberate, and on balancing the Order 2 rule 5 factors restoration would cause prejudice and was not justified; provisional costs were awarded to the respondent.
