The offence of driving with excess passengers can only be committed if a motor vehicle is being driven and therefore falls within the phrase 'in connection with the driving of a motor vehicle' for the purposes of s.23(1); accordingly a magistrate has jurisdiction to order disqualification for this offence. Although the magistrate misdirected himself by considering alleged uninsured status and matters not charged, the disqualification order was nonetheless proper and the appeal is dismissed.
