On the balance of probabilities the judge found the mother intentionally distributed her funds: $2,000,000 gifts to each sibling and to the grandson, $600,000 repayment by Angel, and $5,087,012.04 as a gift/reimbursement to the son; there was no cogent evidence of an express or resulting trust in favour of the mother for the claimed sums, the plaintiffs case shifted materially over time and contemporaneous events (family meeting and bank visit, mothers signing of transfer forms) supported the sons account; accordingly the plaintiffs claim failed and was dismissed.
