The Tribunal held that for this proposal the proper valuation date was the date the list came into effect (3 March or 1 April 1977) under s.7(6); the Commissioner failed to give sufficient weight to the marked market rise in late 1976 and should have adjusted the projection before declaration; preserving the tone of the list does not justify retaining a major incorrect valuation; consequently the rateable value was increased to HKD 66,000 and the Valuation List must be amended effective 1 April 1982.
