The trial judge's assessment that the wife's evidence was credible and that the husband's conduct made it unreasonable for her to live with him was supported by the evidence and not manifestly wrong; the criminal acquittal did not prevent a civil finding on the balance of probabilities. The appeal is dismissed.

Applying the Livingstone‑Stallard/Rayden test to the marriage history, the court found repeated assaults, threats (including threats to use a hammer and a chopper), domination and conduct causing the wife to fear for her safety cumulatively made it unreasonable for her to live with the respondent; therefore the marriage had irretrievably broken down and a decree nisi was granted.

On the evidence the court found the petitioner's complaints insufficiently substantiated and primarily attributable to the petitioner's neurotic and violent temperament rather than grave misconduct by the respondent; therefore the marriage had not irretrievably broken down due to the respondent's conduct and the petition for divorce was dismissed.
