The Court held that the primary user was non-domestic from around July 1973 to about March 1974 and that, because the premises were non-domestic at the relevant time when the landlord sought to obtain possession (date of service of the notice of termination), the defendant was not a protected tenant under Part II; accordingly the plaintiff was entitled to an order for possession.
