The magistrate was entitled to reject the appellant's account because the observed act of the co-accused placing cigarettes at the appellant's feet, together with the electricity bill in the appellant's name at the address where further cigarettes were found, made the innocent explanation implausible; on that basis the inference of guilt was overwhelming and convictions were upheld.
