The court held that the plaintiff's common‑law action was time‑barred in respect of certain dependents because the ownership/use of the pier was ascertainable prior to issuing the writ; however the defendant owed a duty of care in respect of the pier, breached that duty by failing to provide safety measures, the breach caused the death, contributory negligence was not proved, and damages of HKD 72,000 were awarded to the successful dependent (PW4) with interest; prior ECC payment was not set off against that award.
