Misconduct in public office is committed only where the accused abuses powers, discretions or duties vested in the officeholder for the benefit of the public; not every government employee is a 'public officer' for the offence. The respondent, a truck driver without relevant public powers or discretions, could not have abused public office and therefore his conviction for misconduct in public office could not stand.
