The court held that on the facts the defendant owed a duty to the plaintiff in his capacity as a lawful visitor to the basketball court because it was foreseeable that a ball could be driven into the closed volleyball court and that a player would seek to retrieve it; the defendant breached that duty by failing to provide an effective means (eg notice giving a telephone number) to obtain assistance, and that breach caused the accident (with contributory negligence apportioned at 50%).
