The court exercised its discretion to refuse admission of the proposed fresh evidence because Item 1 was unnecessary and would not influence the appeal and Items 2 and 3, although post-hearing, did not materially affect the issues on appeal; conversely, the court ordered service of the notice of appeal on Sik Chiu Yuet because he was directly affected by the Judge's treatment of him as a joint applicant and entitled to be heard on grounds challenging his entitlement, and therefore must be served within seven days.
