The Court rejected the procedural irregularity ground because the appellant's representative elected to continue and there was no demonstrated prejudice, but held the 12 month removal was disproportionate in all the circumstances (including the suspended 6 month criminal sentence and evidence of the appellant's stress) and therefore reduced the period of removal from 12 months to 6 months.
