The court accepted the curved boundary as defined in HM's 1997 plan and subsequent government records because the Plaintiff failed to prove HM's plan was wrong; the earlier deposited ALS plan and consistent subsequent official records and expert correlation supported the curved boundary and the existence of the Wedge resulting from the 1969 subdivision which placed the disputed area in the Defendant's lot; JB's survey evidence was found unreliable in key respects; accordingly the Plaintiff's claim failed and the Defendant was entitled to a declaration of boundary and nominal trespass damages.
