The charging orders registered in 1991 had ceased to have effect under s.17 of the Land Registration Ordinance because they were not re-registered within five years; there was therefore no subsisting charge capable of affecting the defendants as subsequent purchasers and the plaintiff accordingly established good title under the agreement, so the court granted the declaration sought.
