Because the notice to quit was ineffective under ss.52–53 and the settlement terms did not manifest a retrospective intention, the principal tenancy continued at least until August and the principal tenant was entitled to retain rent for that period; therefore the adjudicator's order requiring repayment was wrong and is set aside.
