The Tribunal concluded that Clause 4(f) of the DMC together with the 1998 amendment to the Building Management Ordinance (s.18(2)(fa)) authorized the Incorporated Owners to carry out the improvement works including adding a lift; the disputed works were on the agenda and approved at the 215 EGM as evidenced by the meeting List; respondents failed to demonstrate a reasonable prospect of success on any ground of appeal; accordingly leave to appeal was refused and costs awarded to the applicant.
