The court granted relief under s106(2) because the evidence established inadvertence (one omitted upload amid extensive compliant activity and heavy workload of the agent), there was no evidence of bad faith, and, notwithstanding unexplained delay in seeking relief, it was just in all the circumstances to except the non-compliance; accordingly the applicant was excepted from liability under s105(9) by operation of s106(4).
