There is a bona fide conflict between the registered DMC and the registered Assignment about whether the Facility are common or exclusively assigned; that conflict constitutes a serious question to be tried, damages are inadequate and the balance of convenience favours preserving the Facility in service; therefore interim relief (mandatory reconnection and prohibitory injunction against disconnection) is warranted.
