- Court
- District Court
- Case number
- DCCJ4160/2003
Although a collateral contract between the employee and insurer could exist making the employee an insured and the deceased was held to be a full‑time employee and therefore eligible, the designated beneficiary did not become trustee and the statutory vesting rules (s13) vest the proceeds in the insured's legal personal representative or appointed trustee; the Plaintiff was not the administratrix or a trustee and therefore had no right to enforce the policy; claim dismissed on that basis, with no order as to costs.
