The Court held that the public interest litigation exception applied: the appeals raised matters of obvious general and public importance, applicants sought no private gain and there was a real prospect of success; accordingly there shall be no order as to costs in FACV 6,7,8 and 9 of 2020, the Court of Appeal's 'no order' costs decisions are confirmed and the first instance costs order in HCAL 2949/2019 is left undisturbed; Leung Kwok Hung's costs to be taxed under the Legal Aid Regulations.
