At the time the writ was issued the plaintiff did not have a reasonable prospect of recovering more than the District Court jurisdiction once employee's compensation and realistic earnings were taken into account; accordingly the Registrar ordered costs to be taxed on the District Court scale.

At the time the writ was issued the plaintiff had a reasonable prospect of recovering an amount that could exceed the District Court jurisdiction, taking into account medical evidence, likely PSLA at the higher end, loss of earnings and other heads even after crediting prior employee's compensation; therefore High Court scale of costs applies and costs are to be taxed on the High Court scale if not agreed.

Judge accepted plaintiff's account supported by a reliable co-worker, found defendants breached their duty by leaving the unsafe makeshift ramp in use and failing to remedy hazardous spilled concrete; volenti failed; apportioned contributory negligence at one third; held main contractor liable under Reg 38A; awarded damages after interest, reduced for contributory negligence and offset by employees' compensation to final sum of HKD 269,793.30.
