On the balance of probabilities the applicant failed to prove that the respondent was his employer. The court found the applicant unreliable and that contemporaneous documents, police interviews and medical evidence undermined the applicant's account. The respondent's consistent account and documentary evidence corroborating his employment by Maahir were preferred. Consequently the employees' compensation claim against the respondent was dismissed for lack of proof that the accident arose out of and in the course of employment by the respondent.
