On the totality of objective indicia (control over hours and work, provision of tools, payment practices, absence of entrepreneurial attributes, and evidence of payment by Mr Yip) the relationship was an employment relationship with Mr Yip as employer; therefore Mr Yip is liable under the Employees' Compensation Ordinance.
