The judge found the defendant's explanation that he signed as company specimen signatures not credible in light of the signatures being his personal signatures, the absence of a company chop and the commercial context of Majone's insolvency; under s28 BEO those endorsements rendered him an accommodation party liable to the plaintiff; accordingly the defendant had no real defence and summary judgment was appropriate.
