The Court of Appeal upheld the primary judge’s findings on the evidence that Tse’s Brothers held Unit 16G on resulting trust for Chong Sang and Tai Wing in equal shares, that the Composite Agreement and Oral Agreement reflected the parties’ understanding and that proprietary estoppel applied; the appeal by Tai Wing was dismissed. Because the Mainland judgment relied on below was subsequently overturned, the Court allowed Chong Sang’s appeal on mesne profits and set aside the order requiring him to pay 50% of mesne profits and related expenses from January 2013.
