The court varied the costs order nisi to party and party basis because there were no wholly exceptional circumstances to justify solicitor and own client taxation and the plaintiff advanced no factors in the variation application to justify departing from the usual party and party starting point.

The petitioner's proceedings and substituted service were justified on the evidence that the Lee On Road address was the debtor's last known address and the accounts were validly terminated for breach; accordingly the debtor must pay the petitioner's costs, to be taxed if not agreed.

Where parties have expressly contracted that unpaid charges will attract recovery of costs on a solicitor and own client basis, the court must give effect to that contractual right and may enter judgment for those costs to be assessed by taxation; the District Judge erred in refusing to do so on the ground of fettering the court's discretion or because the provision was penal.
