The defendant's non est factum defence failed because he was an adult of capacity who acted carelessly and there was no duty on the plaintiff to explain documents; there was no expert rebuttal on Singapore law and no evidence the junkets were the plaintiff's agents; the dishonoured cheque was enforceable independent of any dispute over the underlying credit, therefore partial judgment for the plaintiff on the cheque was appropriate with leave to defend only the difference between the SGD claim and the cheque amount.
