Leave to appeal was refused because the plaintiff failed to demonstrate reasonable prospects of success: the penalty interest provisions are sufficiently complex and potentially in breach of ss.24/25 of the Moneylenders Ordinance giving the defendant an arguable defence, the Instrument was modified by the Deed of Modification so summary judgment on principal/2007 interest was inappropriate, and the litigation should proceed to a speedy trial for full resolution.
