The court held it lacked jurisdiction to review and rehear its own decision after a full hearing; Practice Note 42/1/3 applies only to correcting slips before a judgment is perfected; the appropriate remedy for an unhappy party is appeal rather than a de novo rehearing in the same court.

On the balance of probabilities the Tribunal preferred the applicant's evidence and found the notification to collect the registered letter was not delivered to her letter box; the applicant rebutted the presumption of service by post under s8; consequently Form CR101 was not duly served and the respondent failed to terminate the tenancy, which therefore continued statutorily subject to payment of the existing rent and observance of its other terms.

Tribunal has power to enlarge time under s.10(2)(d) and "good cause" should be read in a general sense including the soundness of the applicant's claim and reasonable reliance on professional advice; on the facts the applicant's claim was likely to succeed on liability, reliance on advisers and subsequent litigation produced the delay but did not cause injustice to respondent, therefore good cause established and time was enlarged with an order to deliver the claim within seven days.
