There was no material non‑disclosure by the plaintiff and, on a holistic evaluative judgment of the evidence (defendant's secret acquisition and sole ownership of the policy, evasive conduct, threats, inconsistent statutory declaration and the structure of the arrangement), a real risk of dissipation existed; therefore the ex‑parte Mareva injunction was properly granted and should not be discharged.
