Owners of sub-divided shop units who have registered undivided shares and exclusive possession under registered sub-deeds of mutual covenant fall within the statutory definition of 'owner' of a 'flat' for the purposes of s5B and Schedule 11 of the Building Management Ordinance; therefore each such owner is counted individually when computing the quorum for a corporation of owners, and the Lands Tribunal judge erred in restricting counting to units referred to in the Main DMC only.
