The Tribunal found the Respondent occupied the entire Pink Area including the disputed storeroom; the Pink Area excluding the triangular staircase space (Rear Portion) (total 160 sq ft) is common parts under the DMC; the Respondent converted and obstructed those common parts and breached s.34I(1)(a) and s.34I(1)(b)(ii) BMO until she complied with the undertaking on 2 March 2021; equitable defences failed; mesne profits were awarded from 12 March 2019 to 2 March 2021 totalling HKD 494,230.
