The written loan agreements, multiple professionally drafted extensions, contemporaneous communications and security deeds directly contradicted the alleged oral agreements and variations; contractual clauses requiring written amendments rendered any alleged oral variations ineffective; DW's assertions were inherently implausible and unsupported by contemporaneous evidence and amounted to a frivolous defence and an abuse of process, warranting summary judgment and striking-out and indemnity costs.
