The trial judge validly assessed witness credibility, rejected Ms Zhang's unreliable aspects, accepted Mr Pan as a credible independent observer, found the discrepancies immaterial to the central issue and concluded the fall was not accidental; that finding was not illogical or impossible and supports upholding the conviction.

The appeal is allowed because the learned Magistrate failed to give adequate reasons addressing material and conflicting evidence from PW1, PW2 and PW4 and did not explain why certain witnesses were disbelieved; those failures left a lurking doubt requiring that the conviction be quashed and the sentence set aside.

Because material and unresolved contradictions existed about the nature of the weapon and there was no evidence to contradict the appellant's claim that he required the knife for his trade, the prosecution failed to exclude lawful excuse beyond reasonable doubt; the conviction was therefore unsafe and was quashed.
