Leave to appeal was granted because, applying the Smith v Cosworth realistic prospect test as adopted in Hong Kong, the court could not conclude the Plaintiff had no realistic prospect of success on appeal despite many primary findings being unlikely to be overturned; however the judge upheld his inference that the parties had operated with a 25% commission in the months in question based on the Plaintiff's own handwritten records and arithmetic showing reserves remained positive even if 30% were applied.
