On the evidence the plaintiff failed to prove that the 2nd defendant breached any duty that caused the accident: there was no probative evidence that the boat was travelling at excessive speed, no basis to impose a duty to supply helmets or to prevent competent adult passengers from wakeboarding after drinking, no causative failure to have an observer, and no admissible expert basis to infer negligence; res ipsa loquitur did not apply; therefore the 2nd defendant was not liable and the plaintiff's claim against him was dismissed.
